Terms of Service

These Terms of Service (the "Terms") govern the DEL Creators network at delcreators.com (the "Service"), operated by DEL Records, Inc.("DEL," "we," "us"). By applying for or holding a membership, you agree to these Terms and to the Privacy Policy.

1. Eligibility

You must be 18 years of age or older and reside in the United States or Mexico. You must provide accurate information, including social handles that you actually control. One account per person.

2. Membership is discretionary

Membership, invitations, tiers, and perks are granted at DEL's sole discretion, based on fit and engagement, and may be modified, paused, or revoked at any time. Membership is free: no perk, invitation, or benefit ever requires a payment or purchase, and perks have no cash value and are not transferable or redeemable for money.

3. Independent relationship

Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship. You participate as an independent contractor. You are responsible for your own taxes on any amounts we pay you, and we may report payments to tax authorities as required by law. Before any payment, you must complete the applicable tax form (W-9 for US persons, W-8BEN for Mexico residents) and keep it current.

4. Campaigns and payments

Paid campaigns are offered through written campaign briefs. The brief states the deliverables, deadline, platforms, flat fee, and usage terms. A campaign is binding only after you accept it in the Service. Payment is due after your deliverable is approved, and we may withhold payment while a required correction under Section 6 is outstanding or while your tax form is missing or invalid. Creators who reside in Mexico are engaged for deliverables created in Mexico.

5. Your content and license

You keep ownership of the content you create. For each campaign submission, you grant DEL a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, distribute, display, and share that content, with the specific usage tier (for example organic reposting or paid media, and its duration) stated in the applicable campaign brief. You also grant DEL permission to use your name, handle, image, and likeness as they appear in your submissions and at our events, per the release you accept at submission. You represent that your content is your own, does not infringe third-party rights, and that any music used is licensed under the campaign brief.

6. Disclosure and compliance

You must follow all advertising disclosure laws in every paid or incentivized post: in the US, a clear #ad disclosure plus the platform's paid partnership label; in Mexico, #Publicidad plus the platform's branded content tools. Each brief includes the exact disclosure block, and using it is a condition of payment. DEL may require you to correct or take down a non-compliant post and may withhold payment until it is fixed. Repeated non-compliance may end your membership.

7. Conduct

Do not submit unlawful, hateful, or deceptive content; do not buy engagement; do not misrepresent metrics or identity; follow venue rules and event terms at DEL events. We may remove content or members that put the community, artists, or DEL at risk.

8. Copyright complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice compliant with 17 U.S.C. § 512 to our designated agent at dmca@delrecords.com, including identification of the work, the allegedly infringing material, your contact information, a good-faith statement, and your physical or electronic signature. We respond to valid notices, including removal and, for repeat infringers, account termination. Counter-notices may be sent to the same address.

9. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, DEL's aggregate liability arising out of the Service is limited to the amounts DEL paid you in the twelve months before the claim, and DEL is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.

10. Termination

You may leave at any time by emailing creators@delrecords.com or requesting account deletion. We may suspend or end memberships for breach of these Terms. Sections 3, 5, 8, 9, and 11 survive termination, and licenses already granted for delivered campaigns continue for their stated term.

11. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Los Angeles County, California.

12. Language

For members who reside in Mexico, the Spanish-language version of these Terms at /es/terminos is the controlling version, and it prevails over this English text in case of any discrepancy.

13. Changes and contact

We may update these Terms with a new version date; material changes will be notified by email before they take effect, and continued membership after that date is acceptance. Questions: creators@delrecords.com, DEL Records, Inc., Los Angeles, California, USA.
